Update Course on the New Federal Criminal Procedure Code (completed)

Given the imminent implementation of the new Federal Criminal Procedure Code in the jurisdictions of the Federal Court of Appeals of Mendoza (Mendoza, San Juan and San Luis), we present this refresher course, intended for advanced students, lawyers, employees, officials and magistrates of the Public Ministries and the Judicial Power of the Nation and judicial operators in general, with the aim of providing the theoretical and practical knowledge necessary to face the transition in federal justice from the old “mixed” criminal prosecution system to the new “adversarial accusatory system ”.

For this, during the course not only will theoretical aspects of the new procedural legislation -and the principles derived from the accusatory system- be addressed, but the experiences of the Judges, Prosecutors and Defenders of the provinces of Salta and Jujuy will also be exposed. when implementing the new Federal Criminal Procedure Code in their respective jurisdictions.

It should be remembered that after the enactment of this new Code, its entry into force was suspended and subject to the progressive implementation schedule established by the Bicameral Commission for Monitoring and Implementation of the Federal Criminal Procedure Code. Thus it was that in mid-2019 the new procedural regime was implemented in the provinces of Salta and Jujuy and later it was determined that the jurisdictions of the Federal Chambers of Mendoza and Rosario would be the next to continue with the implementation.

The Refresher Course has a minimum and a maximum capacity. Priority will be given to teachers and graduates of the School of Law and Social Sciences of the Mendoza University.

The Update Course on the new Federal Criminal Procedure Code has as specific objectives:

• • Training of professionals in criminal procedural law on the basis of the new paradigm of an accusatory code about to be implemented in the federal jurisdiction.

• • To promote a correct normative application, tending to contribute the incorporation of theoretical and practical knowledge that revalues ​​Justice as a common good.

• • Train judicial operators, lawyers and graduates in the handling of substantive and adjective instruments, establishing basic criteria based on respect for human rights.

• • Introduce the student to the strengths and weaknesses of the practical application of an accusatory code and the new techniques of oral litigation.

• • Promotion of values ​​on respect for constitutional guarantees.

• • Reflection of judicial, executive and legislative proposals for a better concrete application of the new adjective code.

The Refresher Course is intended for advanced students, judicial operators, lawyers and graduates.

Introductory aspects of the accusatory system. Rules, principles and guarantees. Orality, immediacy, speed. Roles of judges, prosecutors and defenders. Test media and their production. The impact of technology on crime investigation.

Introduction to oral litigation. Case theory: its strategic importance in the process. Basic concepts of the general theory of the process. Structure of the oral process.

The role of the judge in the process. Judge of Guarantees. Functions and competence. Control of the prosecution. Review Judge. Judge of trial and execution.

The implementation of the CPPF in the Salta and Jujuy jurisdiction. A practical view from the perspective of the judges. Functioning of the Judicial Office.
