Universidad de Mendoza, since its creation, has not been and is today not immune to the profound changes that have taken place in the contemporary world. Like never before, transformations at all levels (political and geopolitical, economic, environmental) have had a profound impact on life in society. In all academic activities in each of its units, the University has noted the need for the Institution to respond to those changes.

In particular, the School of Legal and Social Sciences has understood that the creation of Research Institutes that not only accompany the legal evolution but can even anticipate it by carrying out research work is an effective and conducive mechanism. that provide effective responses for the adaptation of the regulatory system of the Province to all those transformations to which reference has been made.

This is how the Institute of Criminal Procedure Law was born within the School, separated from the original Institute of Criminal Law. Undoubtedly, not only in the Province but throughout Argentina and even in Latin America, the Science of Procedural Law has seen its foundations shaken by the new concepts accepted worldwide regarding the scope of prior trial or due legal process and its guarantees of rank. constitutional (inviolability of the defense, limitations on freedom, orality, single-person courts, the crime not only as an infraction of the law of the State but as a conflict); special procedures and alternative solutions; trials with juries and all the procedural consequences of their intervention.

To this must be added the indisputable influence of the internationalization of procedural institutes derived from transcendental studies and advances regarding Human Rights. This is how everything related to Conventional and Treaty Law and the activity of the Inter-American Commission on Human Rights and the Inter-American Court is relevant today and, consequently, research tasks in this regard are necessary.

In this, the School of Legal and Social Sciences does not fail to note that an Institute like the one presented here has a wide field for carrying out activities in the scientific field, with the possibility of generating public and even private policies, aimed at obtaining a harmonious development of the procedural institutions of the Province with reference to all the innovations that have been mentioned in previous paragraphs.

The name of the Institute reflects the intention to carry out work in the procedural legal field and interact with official and private organizations that are related to the activity that takes place in the forensic field, especially in criminal and juvenile jurisdictions.

MISSION

The carrying out of activities in the scientific field, with the possibility of generating public and even private policies, aimed at obtaining a harmonious development of the procedural institutions of the Province.

VISION

Carry out work in the procedural legal field and interact with official and private organizations that are related to the activity that takes place in the forensic field, especially in criminal and juvenile jurisdictions.

OBJECTIVES

That reality to which reference was made and its consequences have been the seed that has allowed this Institute to germinate, which then has the following objectives:

1) Analyze the criminal procedure system of the Province, its operation and its effectiveness

2) Carry out studies and research related to the new laws issued by the provincial Legislature with criminal procedural content.

3) Carry out research on the way in which regulatory provisions related to the imposition of coercive measures are applied

4) Investigate the criminal execution system insofar as it is related to the procedures for compliance with criminal sanctions.

5) Undertake critical studies and research regarding the functioning of the provincial Justice, both in the branch of the Judiciary and the Public Prosecutor's Office and the Public Ministry of Defense.

6) Carry out research regarding the Trial with juries of the Province and critically analyze the current regulations on the subject.

7) Conduct research of a comparative nature between the different procedural systems in force in the Argentine provinces and also at the national level.

8) Schedule scientific activities (courses, meetings, workshops, conferences) related to the procedural innovations that have occurred and will occur in the future, encouraging the intervention of scientists and Professors from other Universities.

9) Deepen existing relationships with European Universities and Institutes.

10) Promote the already begun collaboration of House Professors (members of the Institute) in international research work.

11) Establish as a goal the periodic publication of the research work carried out.

12) Seek an effective way to integrate the Institute with Professors from the School's teaching staff, but also with undergraduate and postgraduate students who demonstrate interest in research in the fields covered by the Institute.

LINES OF INVESTIGATION

Before this Institute was formed, several of the professors who are part of it today began research activities, the results of which gave rise to various publications. Thus, it was published Guide to your rights in the penal process in two volumes (2008), the Commented Criminal Procedure Code of the Province of Mendoza in two volumes (2013) and recently the collective book Laws of Reforms to the Criminal Procedure Code Province of Mendoza (2022).

Likewise, they participate in research projects accredited by DIUM related to the main lines of research: Criminal procedural principles and comparative criminal procedural systems.

Currently, the lines of research on which this Institute focuses its analysis refer to resonant topics on the procedural agenda at the local and international level, in order to generate useful contributions for all those students of the subject. They are the following:

1.-Laws of Reforms to the Criminal Procedure Code of the Province of Mendoza

2.- Comparative Criminal Procedure Systems

3.- Procedural Law and Artificial Intelligence

4.- University Education in Criminal Litigation

5.- Procedural Aspects linked to Digital Evidence

ACTIVITIES

-Participation in University Criminal Litigation Competitions

The activity is proposed within the framework of the national competitions organized by the National Institute of Comparative Studies in Social and Criminal Sciences (INECIP) in which the Universidad de Mendoza participated for the first time in 2019. It consists of preparing groups of undergraduate students who will intervene as parties in a criminal process, in which they must apply adversarial litigation techniques against teams from other Universities. This activity includes organizing preliminary competitions between students of the Universidad de Mendoza and other regional universities.

Litigation Workshop

The implementation of the proposed Workshop would favor the fulfillment of one of the objectives set out in the ongoing research project awarded by competition at DIUM, for execution during 2021/2023 called "University teaching of criminal litigation" directed by Prof. Darío A. Dal Dosso. The workshop promotes the exercise of adversarial criminal litigation skills and its objective is to train students interested in the integration of teams that participate in university criminal litigation meetings.

The teaching team is made up of Professors of Criminal Procedure Law, Chair “B” of the Universidad de Mendoza, Central campus, Dr. María Paula Quiroga; Mgters. Darío A. Dal Dosso, Ladislao Abalos and Juan Manuel Pina. The workshop is intended for fourth and fifth year students who have studied and/or passed Criminal Procedure Law and is held on Wednesdays starting in June 2023 between 18,00:20,30 p.m. and XNUMX:XNUMX p.m., in person, in classrooms of the School of Legal and Social Sciences.

Meeting held on August 24, 2023 at the School of Legal Sciences Universidad de Mendoza in conjunction with the Alberto Hurtado University of Chile. With the participation of Drs. Miriam Henríquez, Jaime Arellano and Rafael Blanco from the Alberto Hurtado University and Drs. María Paula Quiroga, Darío Dal Dosso, Gustavo Pirrello, Verónica Manrique and Juan Manuel Pina for the Universidad de Mendoza.
